Introduce
This policy implements the procedures described in Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 (DMCA), for reporting alleged copyright infringement. It is the policy of the National Academies of Sciences, Engineering, and Medicine, and the National Academies Press, to respect the legal rights of copyright owners, their agents and representatives. Users of any part of GalaxySprout must respect the legal protections afforded by applicable copyright laws.
Appointed Agent
Notices of alleged infringement should be sent to our designated agent. When we receive notification of a claimed infringement, we will follow the procedures outlined on this page and in the DCMA. Complaints made to our designated agent will be communicated to the appropriate web content administrator within GalaxySprout.
Complaint Notification Procedure for Copyright Owners
Notice of alleged copyright infringement to the designated agent must include the following:
An electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
Identification of the material that is claimed to be infringing or that will be the subject of infringing activity, and that is to be removed or access to which is to be disabled, and information sufficient to enable persons in Korea to locate the material.
Information is sufficient for GalaxySprout to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party can be contacted.
A statement that the complaining party has a good faith belief that the use of the material that is the subject of the complaint is not authorized by the copyright owner, its agent, or the law.
Represent that the information in the notice is accurate and that, under penalty of perjury, the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Failure to include all of the above information may result in delays in processing or DCMA notifications.
Notification and Removal Procedures
All users of any part of the GalaxySprout System are subject to applicable copyright laws. However, if GalaxySprout is notified of a claimed copyright infringement, or otherwise becomes aware of the facts and circumstances of an apparent infringement, we will respond expeditiously by removing or disabling access to the material claimed to be infringing or material deemed to be the subject of infringing activity. If our designated agent receives a counter-notification, GalaxySprout will comply with the appropriate provisions of the DMCA.
Repeat Infringer
In appropriate circumstances, GalaxySprout may, in its sole discretion, terminate the authorization of users of our systems or networks who are repeat infringers.
Adaptation to Standard Technical Measures
It is GalaxySprout’s policy to accommodate and not interfere with standard technical measures that we believe to be reasonable in the circumstances, in other words, technical measures used by copyright owners to identify or protect copyrighted works.
